affiliates shall be liable for any loss, inconvenience, or damage. IN NO CASE SHALL EPSON
OR ITS AFFILIATES OR REPRESENTATIVES BE LIABLE FOR ANY INDIRECT, INCIDENTAL,
SPECIAL OR CONSEQUENTIAL DAMAGES, WHETHER BASED ON BREACH OF WARRANTY,
BREACH OF CONTRACT, NEGLIGENCE, STRICT TORT LIABILITY, OR ANY OTHER LEGAL
THEORY.
In Canada, warranties include both warranties and conditions.
Other Rights You May Have. This warranty gives you specific legal rights, and you may
also have other rights which vary from state to state. Some states do not allow limitations
on how long an implied warranty lasts, or allow the exclusion or limitation of incidental or
consequential damages, so the above limitations or exclusions may not apply to you.
Arbitration, Governing Laws: Any disputes arising out of this Agreement will be settled by
arbitration to be conducted in Los Angeles, California, in accordance with the commercial
Arbitration Rules of the American Arbitration Association, and judgment upon the award
rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. This
Agreement shall be construed in accordance with the laws of the State of California, except
this arbitration clause which shall be construed in accordance with the Federal Arbitration Act.
